1. Agreement to Terms
By accessing this website or engaging ERRE Agency for services, you agree to be bound by these Terms of Service and any applicable Statement of Work (SOW), proposal, or agreement.
If you do not agree with these Terms, you may not use our services.
2. Services Overview
ERRE Agency provides custom digital services including website design and development, branding, marketing, content creation, and ongoing growth strategy.
Services are delivered under a subscription-based model or custom agreement, depending on the client’s selected plan.
3. Custom Scope of Work
All services are tailored to each client. Specific deliverables, timelines, and responsibilities are defined in the applicable SOW or agreement.
Any request outside the agreed scope may require additional fees or a revised agreement.
ERRE Agency reserves the right to determine whether a request falls within or outside the original scope.
4. Subscription & Billing Terms
All recurring services are billed on a monthly subscription basis.
- Billing is anchored to the date of the client’s initial payment
- Future payments are automatically due on that same calendar day each month
- Clients are responsible for maintaining a valid payment method on file
Failure to process payment does not cancel or pause the agreement.
5. Payments, Late Fees & Service Interruption
Payments must be made on or before the billing date.
If payment is not received:
- A grace period of up to three (3) days may be applied at ERRE Agency’s discretion
- A late fee may be applied to overdue balances
- Services may be paused, restricted, or deprioritized until payment is resolved
If an account remains unpaid beyond a reasonable timeframe:
- A reactivation fee may be required to resume services
- ERRE Agency reserves the right to terminate the agreement
ERRE Agency is not responsible for any delays, performance issues, or losses resulting from non-payment or late payment.
6. No Refund Policy
All payments made to ERRE Agency are non-refundable.
Due to the nature of custom work, time allocation, and strategic execution, once a payment is processed, it is considered earned.
This applies to all services, including subscription fees, deposits, and completed or in-progress work.
7. Client Responsibilities
Clients agree to:
- Provide accurate information and required assets
- Respond to communications in a timely manner
- Review and approve deliverables within reasonable timeframes
Delays caused by the client may impact timelines, performance, and overall results.
ERRE Agency is not liable for delays resulting from lack of communication or missing materials.
8. Intellectual Property
Upon full payment, clients are granted rights to final approved deliverables as outlined in their agreement.
ERRE Agency retains the right to:
- Showcase completed work in portfolios, marketing, and case studies
- Use non-confidential materials for promotional purposes
Any work that has not been paid in full remains the property of ERRE Agency.
9. Performance Disclaimer
ERRE Agency does not guarantee specific results, including but not limited to leads, revenue, rankings, or conversions.
We provide strategy, execution, and optimization based on industry best practices and data. Results may vary based on market conditions, competition, and client participation.
10. Third-Party Platforms
Our services may involve third-party tools and platforms, including but not limited to hosting providers, social media platforms, CRMs, and analytics tools.
ERRE Agency is not responsible for outages, changes, limitations, or performance issues caused by third-party providers.
11. Termination & Cancellation
Termination terms may be defined within the client’s SOW or agreement.
Unless otherwise stated:
- Written notice is required to cancel recurring services
- Outstanding balances must be paid in full upon termination
- Services will continue until the end of the current billing cycle
No partial refunds or prorated adjustments will be issued.
12. Limitation of Liability
To the maximum extent permitted by law, ERRE Agency shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our services.
Total liability, if any, shall not exceed the amount paid by the client for services in the previous billing cycle.
13. Confidentiality
ERRE Agency agrees to maintain the confidentiality of all non-public client information.
This does not apply to information that is publicly available or required to be disclosed by law.
14. Modifications to Terms
ERRE Agency reserves the right to update these Terms at any time.
Continued use of our website or services after updates constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Georgia, United States.
